Terms and conditions for use of the medical directory Site

These terms and conditions apply to all use made of myHealthSpecialist.com (the or this Site). Please also see our website terms and conditions of use.

These terms and conditions may change at any time and you agree to accept and to be bound by the terms and conditions on this page at any time that you use this Site. You should therefore look at these terms and conditions (the or these Terms) each time you use the Site.

Who we are and who can use this Site

This Site is operated by myHealthSpecialist Limited (we, us or myHealthSpecialist). We are registered in England under Companies House registered number 07964291  and have our registered office at Suite 45, 915 High Road, London, N12 8QJ, United Kingdom. We are registered for VAT under number 135203551.

The Site is open to the public to view Site Listings, but if you wish to use the Site in your capacity as a GP or a Specialist you will  need to become a registered member with us.  

How to register as a member with us

You will need to register as a member with us by completing the registration process on the Site (Online Registration Process). You have the option to register as appropriate, as a GP or a Specialist.  Your registration with us will be effective once we have received your online registration form and sent you your login details.

If you register with us as a GP or a Specialist you warrant that you are either, as applicable, a UK registered medical practitioner who is a practicing or trainee general practitioner (GP) or a specialist medical practitioner with an active licence to practise and GMC specialty registration (Specialist). You agree to inform us promptly via the Site if you cease to be a GP or Specialist at any time after registration.    

Additional Registration Conditions for Specialists

If you are a Specialist you will only be a registered member with us if:

·        you have registered as a new Specialist and are paying membership fees (entitles you to a full profile and the ability to publish private practice details)

·        you have been registered as a Specialist on a free trial (entitles you to a full profile and the ability to publish private practice details)

·        you have registered as a Specialist and have opted for a free NHS-only listing (amended profile in online searches)

If you are a Specialist please refer to the terms and conditions for Specialists to receive an entry at myHealthSpecialist.com for information about how to obtain a full online profile and other information about obtaining a listing on the Site.

Free Trials

This section applies to you if we have offered you access to be registered as a Specialist on a free trial, which entitles you to a full profile and the ability to publish private practice details, for free for a limited period (Free Trial).

All Free Trials are offered at our discretion and shall last for a period of thirty (30) days (or such other period as we inform you) following completion of the Online Registration Process (Free Trial Period); provided we may, at our sole discretion, extend or shorten the Free Trial Period.

If you do not register for a Full Membership and pay the subscription fee payable at the end of the Free Trial Period, in order to continue accessing the additional members-only benefits, then your profile will be cancelled. Upon cancellation of your registration with us your profile will be removed from the Site and you will no longer have access to or any right to use the Site as a registered Specialist.

Your acceptance of these Terms

By completing the Online Registration Process you agree to be bound by these Terms in the form that they appear on this page at the date you complete that Online Registration Process and at any time after that date. By using or accessing this Site at any time you agree to be bound by these Terms as they appear on this page at that time.

Your responsibility to meet the requirements for users of this Site

It is your responsibility to ensure that you meet the requirements for users of this Site. However we may make such checks as we consider appropriate to ensure that you are a UK registered medical practitioner during the Online Registration Process. This may include checking your name against the list of registered medical practitioners held by the GMC (which has been made available to us for that purpose) and you consent to us doing so. Please note that we are not obliged to carry out such checks.

Our rights to refuse to accept registration of any GP or Specialist as a member and cancellation of registration as a member

This section is applicable to GPs and Specialists only

We are entitled, in our sole discretion, to refuse to accept any registration from any person. We may also cancel your registration at any time:

·         by  giving you least  28 days’ notice by email without giving any reason; or

·          if we have reason to believe that you no longer meet the requirements for users of this Site; or

·         we have reason to believe that you are or have been in breach of any of these terms.

You may cancel your registration with us at any time by following the instructions in the My Account section of this  Site. 

Changes to the details you have registered with us

This section is applicable to GPs only

You must keep your registered details with us up to date at all times. You can view and update those details by going to the My Account section of this Site.

What this Site can be used for and what we are and are not responsible for and how listings of Specialists are presented

We are a specialist medical directory Site from which GPs and Specialists can:

·         recommend Specialists for listing on the Site;  

·         search for Specialists that have been recommended by GPs or Specialists who are listed on the Site at any time; and

·         where you are a GP, you can share certain information with other GPs in your practice and view certain information relating to them via the myGroups page.

Additional or alternative facilities and functions may be added to this Site in the future, in which case these terms and conditions may be varied.

We use reasonable endeavours to check that anybody making a recommendation via this Site is a registered medical practitioner at the date of their registration as a member with us.  

We do not check the accuracy of any information relating to any Specialist appearing on this Site. In particular, we are not responsible for any recommendations or the content of recommendations for any Specialist on this Site nor are the doctors that provide these recommendations.

Specialists with recommendations on this Site have been recommended by at least one GP or registered Specialist.   The inclusion of Specialists on this Site is not made on the basis of any approval or vetting by us or any other independent body, nor does the listing of any individual on our site indicate that we have endorsed that individual in any capacity or any recommendation made by that individual.

The order in which Specialists appear for viewing on this Site is determined by a  weighting process based on the total number of GP recommendations and Specialist recommendations we have received through this Site.

It is your responsibility to make sure that a Specialist you select from this Site is appropriately qualified for the purposes for which you intend to make a referral to such Specialist and for all other purposes. You should make such further enquiries as you think appropriate relating to any such Specialist.

All arrangements for you or any third party to use the services of any Specialist are made directly between you or that third party and the Specialist concerned. We do not play any part in those arrangements. We do not take any responsibility for any issues which may arise out of your using the services of, or making a referral to, any Specialist from this Site. Please raise any such issues with the Specialist directly.

We do not offer or provide medical or legal advice or any other  advice.

What you agree to do and not to do.

If you are a GP or Specialist, you agree to ensure:

·         that any recommendations you make via this Site are made in good faith based on clinical experience;

·         that any content or information you provide about yourself and your practice or any Specialist is provided in good faith and is and remains true and accurate. Where any such content or information changes you agree to update it as soon as possible.

You confirm that you either own or are authorised to provide and to license us to use any content or information that you provide us with for all purposes relating to the Site or as may be envisaged by these Terms.

You should not use this Site to make any statements or provide any content which are or could be defamatory, racist, offensive or inappropriate or which may infringe applicable law (“Offending Content”). We reserve the right to remove Offending Content or to suspend or terminate your access to the Site if we consider that you have posted Offending Content.

Access to our Site is granted to you personally as a registered member with myHealthSpecialist.  This Site (other than the home page, search results and recommended specialist profiles) is not available to anybody other than registered members. You should not allow anyone else to access or view this Site. If you have a colleague who meets the relevant requirements for registration and who wishes to view this Site, they should register as a member with us in their own name. If you are a GP any of the details you have provided during the Online Registration Process change, please update these in the My Account section of the Site.

Usernames and passwords

Your username is the email address which you have initially registered with on the Site. You create your own password.

You username and password are personal to you. It is your responsibility to keep your username and password confidential. You should not share that username or password with anyone else. You will be responsible for all activity using your username and/or password.

If you forget your username or password, please follow the steps in the section of this Site.

You agree not to access or to attempt to access this Site using anybody else’s registration details or password or to attempt to find out anyone else’s registration details or password.

You should exercise particular care when accessing the Site from a public computer or one that can be accessed by anyone else. Please ensure that you always log out and that your password cannot be used or accessed by anyone else from that computer at any time.

When our Site is/is not available

Whilst we use reasonable endeavours to make the Site available access to our Site may not be available at all times.  We reserve the right to amend the services which we provide from our Site without notice. We will not be responsible or liable if access to our Site is not available at any time.

Exclusions and limitations of liability

Any material displayed on this Site is provided without any guarantees, conditions or warranties as to its accuracy.

Save as set out below we do not accept any responsibility or liability arising out of your use of this Site or the information available from it. In particular, and without limitation, we exclude all conditions, warranties, terms and provisions which might otherwise implied by statute, law or otherwise from our contract with you.

Save as set out below we exclude all liability for all:

·         loss of profit;

·         direct loss or damage;

·         indirect loss or damage; and

·         consequential loss or damage.

Nothing in these Terms affects, limits or excludes our liability for death or personal injury arising from our negligence or our liability for fraud or misrepresentation or any other liability which cannot be excluded or limited under English law.

Linking/framing to/from this Site

You are entitled to link to this Site but we may at any time at our discretion withdraw our consent to any such linking by you. If we withdraw such consent, you will immediately cease the relevant linking. You agree to comply with any linking policies we have in place at any time.

You are not entitled to frame this Site, unless we give you prior consent in writing. Any such consent may be withdrawn at any time and is subject to any policies or requirements that we may have in place at any time.

Other

If any provision of these Terms is found to be invalid or unenforceable, then the remainder of these Terms shall remain in full force and effect.

You agree that these Terms and any documents referred to in them constitute the entire agreement between you and us regarding myHealthSpecialist and supersede anything previously agreed between you and us.

If we fail to exercise or enforce any right we have under these Terms, this does not mean that we have waived that right and we may still exercise or enforce that right later on.

Any notice we give you may be given to you at any time at the email address we hold on record for you at any time.  Any notice you give us may be given to us at contact.

These terms and conditions are for the benefit of you and us only and do not benefit anyone else.

Jurisdiction and applicable law

The English Courts will have exclusive jurisdiction of any claim or dispute arising from or relating to these Terms or related to between you and us relating to myHealthSpecialist. These Terms and your use and access of our Site are governed by English law.
